PRIVACY INFORMATION STATEMENT

1. INTRODUCTION AND OVERVIEW

This Privacy Statement describes how EPSON America, Inc. ("EPSON") collects, uses, and shares information about you and applies to your use of EPSON Cloud Solution PORT ("ECSP") and all features, content, and other services that EPSON owns, controls and makes available through ECSP or related software, including the Data Collection Agent (collectively, the "Service"). This Privacy Statement does not apply to EPSON’s data collection activities outside of the Service (unless otherwise stated below or at the time of collection).

By connecting your Epson device(s) and using the Service, you agree to the ECSP Terms of Use (“ECSP Terms”), and in doing so, you consent to EPSON’s collection, use and disclosure practices, and other activities as described in the ECSP Terms and this Privacy Statement. If you do not agree to the ECSP Terms and this Privacy Statement, please discontinue use of the Service.

This Privacy Statement is intended to apply to the collection and processing of personal information from customers and individuals in the United States. It does not apply to websites managed or operated by other Epson entities or websites in other countries operated by other Epson entities, including in the European Union. If Epson receives and becomes aware of any personal information of a customer or individual in the European Union, such information will not be processed or retained by Epson America, Inc.

2. INFORMATION COLLECTION

A. Information we collect

EPSON collects information you provide directly to EPSON via the Service and through your interactions with Epson. For example, EPSON collects information when you use the Service, create an account, subscribe to EPSON notifications, communicate with EPSON through the Service, or engage with Epson’s representatives, including.

The information EPSON collects may include Personal Information. "Personal Information" is information that can be used to identify an individual (whether alone or in combination), such as first and last name and email address.

EPSON may also ask you to provide information about your business, such as your business name, designated point of contact and other business related information.

You may choose to voluntarily submit certain other information to EPSON through the Service, including Personal Information, but you are solely responsible for such Personal Information in instances where EPSON has not collected such information or requested that you submit such information to EPSON.

Personal Information once “de-identified” will not be subject to this Privacy Statement and EPSON and its Service Providers (defined below) may treat it as non-Personal Information and use it without obligation to you except as prohibited by applicable law.

Some information is automatically collected by Epson through your use and interactions with the Service (including by the Data Collection Agent and the Embedded Status Agent, which are necessary software components of ECSP), and Epson products, such as Device Information, Log Information and Usage Information. Below we indicate the different categories of information we collect.
Contact Information: includes your first and last name, email address, postal address, phone number and other similar contact information.
Account Information includes information you provide when you create an account with us, such as an Epson Global ID, and may include your IP address, passwords, security information used for authentication and access to the Service, your preferred language for use of the Service, and your time zone.
Users Information: includes information about the users you may invite to Service and who will register for use of the Service under your account, including their contact information, such as name and email.
Partner Information: includes information about the Epson partners you may add to the Service, including their respective contact information.
Log Information: includes Service login and logout information, IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and related data. Epson may issue a session ID to help you navigate the Service and it will expire when you close your browser. ECSP uses “local storage” and “session storage” to keep user interface related information such as language, number of items to be displayed on a page, and account information such as login user, available functions, viewable range for a consistent browser experience.
Usage Information: includes information about your use of the Service and the activities performed under your account. Please note that Epson does not collect or scan the content of files or information you may use with the Service.
Device Information: includes information related to your Epson device/product, such as model, serial number, device manufacture date, device connectivity and configuration, browser version, device location and environment, motor and sensor data, printed page counter, print mode, ink usage and level. Device Information also includes information about the performance of the device, its components, software, firmware, settings, device alerts/warnings, paper used, paper feed log, paper jam count, error reports and history. Device Data includes Printer Data as defined in the ECSP Terms,
Support Information: includes information you provide when you contact Epson for support, either online or offline. When you contact Epson for support, phone conversations or chat sessions with our representatives may be monitored or recorded for training and quality improvement.
B. Information collected from other sources

EPSON may also obtain information about you from other sources and combine that with information EPSON collects about you. To the extent EPSON combines such third party sourced information with Personal Information EPSON collects directly from you on the Service, EPSON will treat the combined information as Personal Information under this Privacy Statement. EPSON is not responsible for the accuracy of the information provided by third parties or third party practices.

Epson may also obtain information from third parties, and Epson protects such information as described in this Privacy Statement, plus any additional restrictions imposed by the source of the information. These third-party sources vary over time and may include (i) Epson partners, with which we offer Epson products, services, or engage in co-marketing activities; (ii) Data brokers from which we purchase demographic data to supplement the data we collect; (iii) Services that make user-generated content from their service available to others, such as local business reviews or public social media posts; (iv) Communication services, including email providers and social networks, when you give us permission to access your information on such third-party services or networks; (v) Service providers that help us determine your device’s location; (vi) Partners with which we offer co-branded services or engage in joint marketing activities; (vii) Publicly-available sources, such as social media, open public sector, academic, and commercial information sets and other data sources.

To the extent Epson combines such third party sourced information with Personal Information Epson collects directly from you on the Service, Epson will treat the combined information as Personal Information under this Privacy Statement. Epson is not responsible for the accuracy of the information provided by third parties or third party practices. Epson uses this information for its legitimate business purposes, which may include to provide and improve the quality of Epson products and services, as well as offer you other products, services and features you may be interested in, all in accordance with the terms of this Privacy Statement. You can unsubscribe from Epson’s marketing communications at any time.

3. USE OF INFORMATION

Epson uses the information it collects to provide the Service to you and for other legitimate business purposes as explained in this Privacy Statement and as authorized by applicable law, including to:
  •  Facilitate, manage, personalize and improve the Service or the online experience through the Service;
  • Manage your account when you create an account with Epson;
  • Conduct ordinary business operations related to the Service and your use of the Service;
  • Provide support to the Service and Epson products;
  • Transact and communicate with you, respond to your comments, questions and requests, provide customer service, send you informational notices, and contact you if EPSON needs to obtain or provide additional information;
  • Conduct research and analysis, including focus groups and surveys;
  • Develop and send you direct marketing, including advertisements and communications about the Service, Epson’s products, offers, promotions, rewards, events, and services. You may opt-out from receiving marketing communications at any time;
  • Prevent and address fraud, breach of policies or terms and threats or harm.
  • Maintain and protect the integrity and security of the Service; and
  • Comply with the law. 
As explained above, some information about your device and use of the Service is automatically collected by Epson. This information is stored in Epson’s secured servers, subject to strict access controls and restrictions. Epson and its affiliates may use this information for internal business purposes, to provide you with a rich experience when you use the Service and Epson products, to analyze the Service and products quality, to provide support, and Epson devices, and to improve the Service and our products. Please note that Epson does not collect the contents of your files or content.


4. ACCESSING ECSP FROM THIRD-PARTY APPLICATIONS

Epson is not responsible or liable for the third-party applications that you download onto your mobile device or its availability, content, accuracy or privacy and data collection practices. Applications developed by third-parties are not operated or controlled by Epson. These third-party applications may have access to Epson Connect to enable printing and scanning on your Epson device. The data collected by these third-party applications is subject to such third-party application’s terms of use and privacy policy. If you decide to download or access the third-party application, you do so entirely at your own risk. We recommend that you review the privacy and data collection practices of such third-party application.

5. SHARING INFORMATION

EPSON’s agents, vendors, consultants, and other service providers (collectively "Service Providers") may receive, or be given access to your information in connection with their work on EPSON’s behalf. These Service Providers are contractually prohibited from using Personal Information for any purpose other than to provide such work, although EPSON may permit them to use aggregate information (which does not identify the data subject) or de-identified data for other purposes.

Epson may share information about you and your use of the Service with Epson’s affiliated companies, including Epson’s parent company, which may be located in other countries. Epson may also share information with its channel partners, resellers, and distributors for legitimate business purposes. When we share your information, we require the recipient to abide by our data privacy and security requirements, and we contractually prohibit the use of Personal Information for any purpose other than as indicated in this Privacy Statement.

EPSON may also share information about you as follows:
  • To comply with the law, law enforcement or other legal process, and except as prohibited by applicable law, in response to a government request;
  • To protect the rights, property, life, health, security and safety of EPSON, the Service or any third party; and
  • In connection with, or during negotiations of, any proposed or actual merger, purchase, sale or any other type of acquisition or business combination of all or any portion of EPSON’s assets, or transfer of all or a portion of EPSON’s business to another company.
Without limiting the foregoing, in EPSON’s sole discretion, EPSON may share aggregated information which does not identify you or de-identified information about you with third parties or affiliates for any purpose.

6. RETAINING INFORMATION

Epson retains personal information, including information about your use of the Service, for as long as necessary to provide the Service to you, support Epson products and services, meet its legitimate business purposes, comply with legal obligations, resolve disputes, and enforce our agreements, as allowed by applicable laws. When personal information is no longer required to meet our legitimate business purposes, we will destroy, delete, or de-personalize the personal information.

7. ADDITIONAL DISCLOSURES FOR U.S. STATE RESIDENTS AND CALIFORNIA RESIDENTS

These additional disclosures apply only to individuals who reside in U.S. states that have passed comprehensive privacy laws, including California. The California Consumer Privacy Act of 2018 ("CCPA") provides additional rights to know, delete and opt out, and requires businesses collecting or disclosing personal information to provide notices and means to exercise rights. Epson will process your information in accordance with the applicable privacy law.

A. Notice of Collection

In the past 12 months, we have collected the following categories of personal information enumerated in the CCPA:
  • Identifiers, including name, email address, account name, IP address, and an ID or number assigned to your account.
  • Customer records, including name, email address.
  • Internet activity, including your interactions with our Service.
  • Device Information, including device serial number and configuration information
  • Device and Usage Data, data about the type of device or browser you use, your device’s operating software, printing patterns, ink usage, your device’s regional and language settings, and device identifiers such as IP address.
For more information on information we collect, including the sources we receive information from, please review Section 2 above. We collect and use these categories of personal information for the business purposes described in Section 3 above, including to provide and manage the Service.

We use and partner with different types of entities to assist with our daily operations and management of the Service and therefore share information with them. Please review Section 5 above for more detail about the parties we have shared information with. In Section 6 above, we explain our information retention practice.

B. Right to Know, Correct, Delete, and Non-Discrimination.

If you are a California resident, you have the right to correct, delete the personal information we have collected from you and the right to know certain information about our data practices in the preceding 12 months. You also have non-discrimination right for exercising your privacy rights. In particular, you have the right to request the following from us:
  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information was collected;
  • The categories of personal information about you we disclosed for a business purpose or sold;
  • The categories of third parties to whom the personal information was disclosed for a business purpose or sold;
  • The business or commercial purpose for collecting or selling the personal information; and
  • The specific pieces of personal information we have collected about you

To exercise any of these rights, please submit a request through our online form available at https://dsar.goepson.com or call our toll free number at 1-800-822-0313. In the request, please specify which right you are seeking to exercise. We will confirm receipt of your request within 10 days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.


C. Authorized Agent

You can designate an authorized agent to submit requests on your behalf. We may require written proof of the agent’s permission to do so and verify your identity directly.

D. Shine the Light

Customers who are residents of California may request (i) a list of the categories of personal information disclosed by us to third parties during the immediately preceding calendar year for those third parties’ own direct marketing purposes; and (ii) a list of the categories of third parties to whom we disclosed such information. To exercise a request, please write us at the email or postal address set out in “Contact Us” above and specify that you are making a “California Shine the Light Request.” We may require additional information from you to allow us to verify your identity and are only required to respond to requests once during any calendar year.

Nevada consumers may submit requests directing businesses not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third party for the third party to license or sell the personal information to other third parties. 8. CHILDREN’S PRIVACY

The Service is not intended for nor targeted toward children under the age of thirteen (13). EPSON does not knowingly collect personal information as defined by the U.S. Children’s Privacy Protection Act ("COPPA") from children under the age of thirteen (13), and if EPSON learns that it has collected such information, EPSON will delete the information in accordance with COPPA. If you are a child under the age of thirteen (13), you are not permitted to use the Service and should not send any information about yourself to EPSON through the Service. If you are a parent or guardian and believe EPSON has collected information in a manner not permitted by COPPA, please contact EPSON using the information provided at the bottom of this policy statement.

9. DATA SECURITY

EPSON takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. Nevertheless, transmission via the Internet is not completely secure, and EPSON cannot guarantee the security of your information collected through the Service.

10. INTERNATIONAL TRANSFER

EPSON America, Inc. is based in the U.S. and the information it collects is governed by U.S. law. If you are accessing the Service from outside of the U.S., please be aware that information collected through the Service may be transferred to, processed, stored and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence. Your use of the Service or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing and storage of your information, including Personal Information, in the U.S. as set forth in this Privacy Statement.

11. CHANGES TO THIS PRIVACY STATEMENT

EPSON reserves the right to revise and reissue this Privacy Statement at any time. Any changes will be effective immediately upon posting of the revised Privacy Statement. Subject to applicable law, your continued use of the Service indicates your consent to the privacy policy posted. If the changes are material, EPSON may provide you additional notice, to your e-mail address.
